The user agrees not to use the NameCheckup service (including but not limited to its content) in any way that is not expressly provided for by these Terms of Service.
NameCheckup, to properly provide its services, may use third party applications, websites and content directly offered by third parties ("Third Party Applications"). The use of these applications is subject to their own terms of use. You acknowledge and agree that NameCheckup is not responsible for the behavior, features, or content of any third-party application.
NameCheckup will make reasonable efforts to keep the service operational. However, some technical difficulties or maintenance operations may cause temporary interruptions. NameCheckup reserves the right to modify or discontinue, temporarily or permanently, the functions and capabilities of the NameCheckup service, with or without notice and without liability to users. NameCheckup reserves the right to throttle user requests if it considers the usage improper.
The Terms of Service remain in force for the period of usage of the service by the user or until terminated by NameCheckup. However, the user understands and agrees that NameCheckup may at any time suspend or completely deny access to the services to any user, without any written notice.
NameCheckup tries to provide the best possible service, but the user understands and agrees that the NameCheckup service is provided "as is" and "as available" without any warranty, express or implied, of any kind. NameCheckup and all content owners do not provide any warranty of satisfactory quality, merchantability, fitness for a particular purpose or non-infringement. NameCheckup does not warrant, affirm or assume responsibility for any third-party application (or its content), user content or other products or services offered by third parties on or through the NameCheckup service. You acknowledge and accept that NameCheckup is not responsible for any transaction between you and third-party suppliers of applications, products or services published on or through the NameCheckup service. No advice or information provided by NameCheckup, whether oral or written, will constitute any form of warranty.
You agree that the sole remedy for any problems or dissatisfactions with the NameCheckup service consists in stopping the use of the service; however, we always welcome feedback via the contact information provided on the site. NameCheckup does not assume any liability for third party applications or their content used within NameCheckup—the relationship with these third-party applications may be governed by separate agreements with those third parties. The sole remedy offered by NameCheckup for any problems or dissatisfaction with third-party applications or their content consists in uninstalling and/or stopping the use of those applications. In no event shall NameCheckup and its officers, shareholders, employees, agents, directors, affiliates, branches, successors, assignees, suppliers or licensors be liable for any indirect, special, incidental, punitive, exemplary or consequential damages, or any loss or misuse of data.
Except as otherwise stated in the Agreements, where any provision of the Agreements is held to be invalid or unenforceable for any reason or at any level, such invalidity or unenforceability shall not render invalid or unenforceable the remaining provisions. Any failure by NameCheckup or third-party beneficiaries to enforce the Agreements or related clauses shall not void NameCheckup's or the third-party beneficiary's right to do so.
By using NameCheckup you agree that when you submit any information to our site you grant to NameCheckup universal, perpetual, irrevocable, commercial and non-commercial rights to use that data to any extent necessary to provide the service (including but not limited to publishing and distributing). You warrant that you have the right to grant us this right over submitted content and at all times you will not claim any charges to NameCheckup for any loss of data for any reason. Because of the complexity of the systems, NameCheckup cannot guarantee that data presented or services provided on the site return correct results; we may use caching techniques to improve our services which may result in data not being up to date.
To the fullest extent permitted, you agree to indemnify and hold NameCheckup harmless from and against any damages, losses and expenses of any kind arising out of: (1) your violation of this Agreement; (2) any user-provided content; (3) any activity in which you engage or perform through the NameCheckup service; (4) your violation of any law or the rights of any third party.
